Those of you who are fans of the grunge band Nirvana, should know this latest news.
Well….a federal judge in Los Angeles, United States has dismissed a man's lawsuit alleging grunge rock group Nirvana sexually exploited him by placing a photo of him as a naked 4-month-old baby on the cover of the 1991 classic album “Nevermind.”
Quoted from Antara, US district judge, Fernando Olguin, on Monday (3/1) local time, rejected the lawsuit against Nirvana by Spencer Elden.
Spencer Elden was judged to have missed the deadline to respond to the defendants' motion to drop the case.
Olguin gave Elden until January 13, 2022, to file an amended complaint to address the alleged issues the defendants identified in his case.
An attorney for Elden did not immediately respond to a request for comment on Tuesday
In a lawsuit filed in August last year, Elden, who was 30 at the time of the lawsuit, claimed he had suffered "lifelong damage" from the album cover, which depicted him swimming naked towards a dollar bill stabbed with a fishhook.
For this reason, Elden requested compensation of at least US$150,000 from each of the defendants. Or about 2 billion rupiah from each defendant.
Those who are being sued for damages are Universal Music Group, Nirvana drummer and Foo Fighter vocalist - Dave Grohl, Nirvana bassist - Krist Novoselic and Courtney Love - widow of Nirvana vocalist Kurt Cobain.
In seeking a resolution to the Elden case, the defendants said Elden's claim that the photo was child pornography was "not a serious problem" in the circumstances.
The defendants also said Elden could not claim to be a victim, having spent three decades or 30 years "benefiting from his title as the 'baby of Nirvana'".
Elden as an adult, has also remade the photo including the tattoo "Nevermind" on his chest.
“Nevermind” is one of the world's best-selling albums ever, with sales of over 30 million copies worldwide.
